Welcome to Clair Fareio Art. By placing an order, commissioning a work, or contacting us, you agree to these Terms & Conditions. Please read them carefully.

1. General Information

Clair Fareio Art (“we,” “our,” or “us”) is an independent art studio operated by Clair Fareio, based in Sulmona, Italy. We sell original artwork and accept commissions for custom pieces worldwide.

2. Products

All artwork is original and handmade by Clair Fareio. Each piece is unique, and slight variations in color, texture, or size may occur. Availability may vary due to the limited nature of original artworks. Product images on the website are representative; minor color differences may occur due to screen settings.

3. Commissions

Commission terms are agreed upon individually between the artist and client prior to commencement of work. A non-refundable deposit may be required to begin a commissioned piece. Timelines are estimates and may vary depending on complexity, size, and studio schedule. The artist retains the right to photograph and display commissioned works for portfolio and promotional purposes unless otherwise agreed in writing. Commissioned works are considered custom and personalized; the right of withdrawal does not apply.

4. Ordering & Payment

Orders may be placed through the website, email, or direct communication. Prices are listed in EUR (€). We accept payments via bank transfer, PayPal, major credit cards, or other mutually agreed methods. For in-person sales within Italy, cash payments are accepted up to the Italian legal limit (currently €5,000). All transactions are documented with a receipt or invoice. You confirm that you are legally capable of entering into a binding contract. We reserve the right to cancel orders if payment fails or cannot be processed. International buyers are responsible for any currency conversion fees.

5. Shipping & Delivery

All artwork is shipped from Sulmona, Italy. Shipping times vary depending on destination and customs processing. Customers are responsible for any import duties, customs fees, or taxes applicable in their country. Risk of loss or damage passes to the buyer once the artwork leaves our studio unless shipping insurance is purchased. We strongly recommend insuring artwork for its full value during shipping. Tracking information will be provided when available. Clair Fareio Art is not responsible for delays caused by customs, international carriers, or events outside our control.

6. Right of Withdrawal (Italian/EU Law)

For EU consumers, the 14-day right of withdrawal does not apply to original, handmade, or personalized artwork (Article 59 of the Italian Consumer Code). Non-EU customers are not covered by EU withdrawal rights. However, we will make reasonable efforts to resolve any issues, as outlined in Section 7.

7. Returns, Refunds & Damaged Goods

Due to the unique nature of original artwork, all sales are final. Refunds or exchanges are generally not available. If your artwork arrives damaged or defective: contact us within 7 days of receipt with photographs. We may offer repair, replacement, or partial refund at our discretion. Any approved refund will be processed via the original payment method. Buyers may be responsible for return shipping costs if a return is requested.

8. Certificate of Authenticity

Each original artwork and commissioned piece includes a signed Certificate of Authenticity verifying the work as an original creation by Clair Fareio.

9. Intellectual Property

All artwork, images, text, and content on this website and in related materials are the intellectual property of Clair Fareio. You may not copy, reproduce, or distribute any content without written permission. Purchased artwork is for personal use only unless a separate commercial license is granted. Photographs of artwork shared on social media should credit the artist where possible.

10. Limitation of Liability

Clair Fareio Art is not liable for indirect, incidental, or consequential damages arising from the use of the website or purchase of artwork. Our total liability for any claim related to purchased artwork is limited to the purchase price of that artwork. We are not liable for loss or damage in transit once artwork is shipped unless insured.

11. Privacy & Data Protection

We respect your privacy and comply with applicable data protection laws, including GDPR for EU customers. Personal information is collected solely to process orders, fulfill commissions, and provide customer service. We do not sell or share your data with third parties except as needed for shipping or legal compliance. 12. Website & Cookies

This website uses cookies for essential functionality and analytics. By using the site, you consent to the use of cookies as described in our Privacy Policy. The website is provided “as is” without warranties of any kind regarding availability, accuracy, or uninterrupted access.

13. Force Majeure

We are not liable for any failure or delay in fulfilling orders caused by events beyond our reasonable control, including natural disasters, strikes, pandemics, or transportation disruptions.

14. Governing Law & Jurisdiction

These Terms & Conditions are governed by Italian law. EU consumers may resolve disputes in the competent courts of Italy or through the EU Online Dispute Resolution platform. Non-EU consumers: Italian law applies unless otherwise required by local legal protections.

15. Changes to These Terms

We may update these Terms & Conditions at any time. Updates will be posted on this page with the new effective date. Continued use of the website or placement of orders after changes constitutes acceptance of the revised terms.

16. Miscellaneous

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions remain in full effect. Failure to enforce any provision does not constitute a waiver of the right to enforce it later.
